Standard Terms and Conditions

RESPONSIBILITIES OF CUSTOMERS AND OTHERS

To provide a sufficient and suitable water and electricity supply at the tank and control centre.

To arrange for plants to be removed and replanted to avoid damage and ensure pipe can be laid discreetly.

To be responsible for positional marking of any mains services etc., liable to affect the installation prior to commencement. Notify the installer of any hazardous items on site.

To obtain all necessary permissions, licences or approvals before installation regarding local byelaws.

 

INSTALLATION

Whilst every effort will be made to ensure that all excavations are replaced with great care, some settlement of soil and lawns may take place.  The equipment will be installed by hand or/and specialist digging machine The majority of pipework will be surface laid in the borders/planted areas where plants cannot be moved.

Extra work or parts not in the quotation will be charged for.

PAYMENT ARRANGEMENTS

Initial payment of 25% with order, with the balance on completion. Stage payments shall apply to a project taking longer than a week due to the project length or delays caused by others, with a maximum final payment of 25%.   V.A.T. is applicable as indicated in the quotation.

If payment is not made by the duly agreed date, we may charge interest at the rate of 2% per month from the due date until payment is made in full.

Reservation of ownership. Title for equipment remains ours until we have received payment in full.

GENERAL / WARRANTY

The Quotation is open for acceptance for 30 days from the date of the covering letter. Verbal orders are valid but please confirm in writing.

The equipment will be covered by a full 12-month warranty from the completion date or spring start up date for winter installations. A 24 month warranty will apply to systems that are maintained by Quality Irrigation.

Our liability is limited to our materials/products and workmanship only.

NOMINATED SUB CONTRACT

The nominated sub contractor reserves the right to refuse a contract from the main contractor when the quotation has been submitted direct to the employer or his agent. All nominated sub contract payments should be covered by a payment guarantee by the employer.

FORCE MAJEURE

The seller does not accept any liability for any direct or indirect loss arising from non delivery or delay in delivery of any goods as a result of inability to secure labour materials or supply, or as the result of war, strike, lock-out, or other labour dispute, fire, flood, explosion, government restriction legislation or act of god or any other cause (whether of the foregoing class or not) beyond the control of the seller.

INDEMNITY

The seller shall not be liable for any defect with respect to the goods or any failure in the goods to meet the purpose for which they are intended or found to be due to any defect in any design instructions or other information or materials supplied by the buyer to the seller. All drawings supplied by the seller remain its property and will be returned on demand. They will not be copied or divulged to a third party or used against the seller’s interests in any way. £2 million Public and £10 million Employers insurance is held by the seller.

PROPER LAW

This contract shall be governed by and constructed in accordance with current English Law.
